After disturbing media reports about seniors’ physical and mental health deteriorating due to increased isolation during the pandemic, lawmakers have started to take action. We’re seeing a number of bills that would allow residents of assisted living to designate one essential caregiver who can visit them, regardless of any health order to the contrary. While the bills vary somewhat, most do allow providers to set certain restrictions on visitation, such as scheduling, use of PPE, etc.
Currently, bills to guarantee visitation are pending in Arkansas, Indiana, Maryland, South Dakota, Texas, and Wisconsin. A law regarding visitation has been passed in Louisiana.
